Terms of Service

These Terms of Service govern your use of legacygtm.com and any services you buy from Hộ Kinh Doanh Legacy GTM, a household business registered in Vietnam ("Legacy GTM", "we", "us"). By using the site or signing up for our services, you agree to these terms. If you sign a separate service agreement with us, that agreement controls where it differs from these terms.

1. Our Services

Legacy GTM provides business-to-business outbound lead generation services. Depending on your package, this can include offer development, prospect list building, cold email infrastructure setup, email and LinkedIn campaign management, appointment setting, sales process support and reporting. The exact scope, volume and price for your engagement are set out in your proposal or order form.

We only provide services to businesses. You confirm that you are buying on behalf of a business and not as a consumer.

2. Fees and Billing

Services are billed monthly in advance, in US dollars, unless your proposal says otherwise. Some engagements include a one-time setup fee for strategy, data and sending infrastructure. Your first payment is due before work starts. Later payments are charged automatically on the same date each month to the payment method on file.

Prices on our site are a guide. Your final price is the one in your signed proposal or invoice. Third-party costs such as data credits, domains and inboxes are included in your fee unless your proposal lists them separately.

If a payment fails, we will notify you and may pause work until it is paid. Payments more than 15 days overdue may lead to suspension of campaigns.

3. Term and Cancellation

Unless your proposal sets a minimum term, your service runs month to month and continues until cancelled. You can cancel at any time by emailing harvey@legacygtm.com at least 30 days before your next billing date. Full details are in our Refund and Cancellation Policy, which forms part of these terms.

4. Your Responsibilities

To get results, we need your help. You agree to:

• Give us accurate information about your business, offer and ideal customer
• Approve campaign copy and offers in a reasonable time
• Attend booked sales calls and follow up with leads we pass to you
• Make sure your product or service is lawful and that any claims you ask us to make are true
• Provide any access to tools or calendars we need to deliver the service

5. No Guarantee of Results

We do not guarantee a specific number of leads, meetings, sales or revenue. Results shown on our website are past results for specific clients and are not a promise of what you will get. Outcomes depend on your market, offer, pricing, sales process and other factors outside our control. Any figures from our calculators or projections are estimates only.

6. Compliance

We run campaigns to business contacts using business addresses, with a clear opt-out in every message, and we honour opt-out requests promptly. We design campaigns to comply with the CAN-SPAM Act and, where relevant, GDPR, UK GDPR and CASL. You agree not to ask us to send content that is false, misleading, unlawful or that infringes anyone else's rights.

7. Intellectual Property

Once paid in full, you own the campaign copy and prospect lists we create specifically for you. We keep ownership of our own methods, templates, tools, processes and know-how, and we may reuse general learnings that do not identify you. Sending domains and inboxes we set up are transferred to you on request when the engagement ends, with any domain and inbox transfer fees charged at cost.

8. Confidentiality

Each party will keep the other's non-public business information confidential and use it only to perform or receive the services. This does not apply to information that is already public or that must be disclosed by law.

9. Limitation of Liability

To the fullest extent allowed by law, Legacy GTM is not liable for any indirect, incidental or consequential losses, including lost profits or lost revenue. Our total liability for any claim is limited to the fees you paid us in the three months before the claim arose.

10. Termination by Us

We may suspend or end services if you breach these terms or your contract with us, fail to pay, or ask us to do something unlawful. If we end services without cause, we will refund any prepaid fees for work not yet performed.

11. Changes to These Terms

We may update these terms from time to time. The updated version will be posted on this page with a new effective date. Changes do not affect any engagement already signed unless both parties agree.

12. Governing Law

These terms are governed by the laws of Vietnam. Any dispute will first be handled through good-faith negotiation. If it is not resolved within 30 days, it will be settled by the competent court of Vietnam.
